KJ Arts Centre® Terms & Conditions

Version 2.1 | Updated October 2026

KJ Arts Centre® is a registered trademark of Sethna Holdings Pty Ltd (ABN 68 561 006 271).

These Terms & Conditions apply to participants, parents, guardians, carers, visitors, volunteers and others attending or participating in programs, classes, workshops, events or activities operated by KJ Arts Centre®.

If you register, book or make a purchase on behalf of another person, including a child, you confirm that you are their parent, guardian or authorised carer and have authority to accept these Terms & Conditions on their behalf.

By registering, enrolling, booking, purchasing a program, accepting these Terms & Conditions electronically or participating in an activity at KJ Arts Centre®, you acknowledge that you have read, understood and agree to these Terms & Conditions.

1. Recreational Activities & Acknowledgement of Risk

KJ Arts Centre® provides recreational services including martial arts, self-defence, physical training, fitness, wellbeing activities, indoor sport, performing arts, creative activities and other recreational programs.

Physical and recreational activities involve inherent risks.

These risks may include, but are not limited to:

  • strains and sprains
  • falls and collisions
  • impact injuries
  • concussion
  • aggravation of existing medical conditions
  • serious injury
  • permanent disability
  • paralysis
  • death

These risks may occur even where reasonable supervision, instruction and safety precautions are in place.

Participants must follow instructor directions, safety requirements and Centre rules at all times.

For the purposes of applicable Australian and Victorian law, participants acknowledge that many services supplied by KJ Arts Centre® are recreational services involving physical exertion and physical risk.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights, guarantees or remedies that cannot lawfully be excluded under Australian law.

KJ Arts Centre® operates under applicable Council requirements as an Indoor Recreational Facility. Participants, parents, guardians and visitors must comply with reasonable safety and operational requirements applying to the premises.

2. Fitness, Health & Medical Disclosure

Participants should only participate within their own physical capabilities.

Participants, parents and guardians are responsible for informing KJ Arts Centre® of any relevant:

  • medical condition
  • injury
  • allergy
  • disability
  • learning requirement or disability
  • physical limitation
  • medication
  • health concern
  • change in health or circumstances

that may affect safe participation.

Information supplied during registration, enrolment, Class Manager registration or any other booking process must be accurate and kept reasonably up to date.

Participants and parents/guardians consent to reasonable first aid being provided and emergency medical assistance being sought where reasonably necessary.

KJ Arts Centre® relies on the accuracy and completeness of information provided when assessing suitability for participation.

3. Personal Injury, Medical Costs & Ambulance Cover

KJ Arts Centre® does not provide personal accident, personal injury or health insurance for participants.

Participants and parents/guardians are strongly encouraged to maintain appropriate personal accident, medical and/or sporting insurance relevant to the activities in which they participate.

Participants and parents/guardians are also strongly encouraged to maintain Ambulance Victoria membership or equivalent ambulance cover.

Ambulance attendance and transport are not necessarily provided free of charge in Victoria.

Any ambulance, medical, hospital, rehabilitation or related expenses remain the responsibility of the participant or their parent/guardian.

4. Mezzanine & Stairway Safety

KJ Arts Centre® includes a mezzanine level accessed by an internal staircase.

Participants, parents, guardians and visitors must take reasonable care when using stairs and elevated areas.

This includes:

  • using handrails where available
  • walking rather than running on stairs
  • not jumping on or around stairs
  • following displayed safety signage
  • using appropriate footwear where required
  • supervising children during arrival, departure and movement outside scheduled class supervision

Participants acknowledge that stairs and elevated areas carry an inherent risk of slips, trips and falls.

To the extent permitted by law, KJ Arts Centre® is not responsible for injury arising from a person’s failure to follow reasonable safety instructions or exercise reasonable care.

5. Bathroom, Wet Areas & Shower Restriction

KJ Arts Centre® includes an ambulant toilet facility containing a shower area as part of the building amenities.

The shower is not available for participant, parent, guardian or visitor use.

Showering on the premises is not permitted unless expressly authorised by KJ Arts Centre® management.

Everyone using bathroom and amenity areas must exercise reasonable care around surfaces that may become wet or slippery.

To the extent permitted by law, KJ Arts Centre® is not responsible for injury arising from unauthorised shower use or a failure to exercise reasonable care in bathroom or wet areas.

6. Child Safety

KJ Arts Centre® is committed to providing a safe, respectful and supportive environment for children.

We have zero tolerance for child abuse, grooming, exploitation or inappropriate conduct.

KJ Arts Centre® maintains professional boundaries, supervision standards, access controls and child-safety practices designed to protect children participating in our programs.

Any safety concern, disclosure, allegation or suspected misconduct may be investigated and, where appropriate or required, referred to Victoria Police, Child Protection or another relevant authority.

7. Drop-Off & Pick-Up

Children’s programs operate using a structured drop-off and pick-up model.

Drop-off should generally be limited to a brief handover period of approximately 2 to 5 minutes.

Parents and guardians should leave the premises promptly after drop-off unless:

  • an exemption has been approved by KJ Arts Centre®;
  • the parent or guardian has been specifically asked to remain;
  • the parent or guardian is actively participating in an authorised class or activity; or
  • another arrangement has been approved by Centre staff.

Children must be collected promptly at the conclusion of their scheduled class.

A maximum late collection grace period of approximately 10 minutes applies.

If delayed due to an emergency, parents or guardians must contact KJ Arts Centre® as soon as reasonably possible on:

0466 017 789

Late pick-ups will be managed in visible and appropriate areas.

KJ Arts Centre® staff do not provide extended childcare and do not transport children home.

8. Parent & Guardian Presence

KJ Arts Centre® does not operate a general waiting room or parent lounge.

The premises are primarily designed for instruction and programmed activities rather than passive supervision.

Parents and guardians are generally expected to leave after drop-off and return for collection unless an exemption or other arrangement has been approved.

Parents, guardians or other adults assisting with instruction, volunteering or participating in activities involving children may be required to hold a valid Working with Children Check where applicable.

Parents or guardians must not independently instruct, coach or supervise children participating in Centre activities unless authorised by KJ Arts Centre®.

9. Supervision Boundaries

Instructor supervision applies during scheduled class times and within designated training areas.

Parents and guardians remain responsible for children outside scheduled class supervision, including:

  • before class
  • after class
  • during arrival
  • during departure
  • in entry areas
  • on stairways outside supervised activity
  • in car parks
  • on surrounding roads or streets
  • in external common property
  • in areas outside the designated training space

KJ Arts Centre® supervision does not extend to public roads, parking areas or surrounding property outside the Centre’s reasonable control.

10. Code of Conduct

Participants, parents, guardians, volunteers and visitors must behave respectfully and follow reasonable instructions from KJ Arts Centre® staff.

Martial arts and self-defence instruction may involve language and scenarios concerning attacking, blocking, striking, defending, escaping, bullying, confrontation and realistic safety situations.

This language is used for education, skill development, confidence, safety and self-defence training. It is not intended to encourage aggression or unlawful violence.

Prohibited conduct includes:

  • bullying
  • intimidation
  • harassment
  • deliberate unsafe behaviour
  • inappropriate physical contact
  • verbal abuse
  • humiliation
  • aggression unrelated to legitimate training
  • deliberately damaging equipment or property
  • refusing reasonable safety instructions
  • inappropriate or secretive interactions with children
  • taking children into secluded or unauthorised areas
  • inappropriate communication with children outside class without parent or guardian knowledge

KJ Arts Centre® may intervene where conduct affects the safety, wellbeing, dignity or reasonable enjoyment of others.

11. Physical Instruction Protocol

Martial arts, fitness, movement and physical training may require instructors to demonstrate or correct positioning, movement, posture, technique or body mechanics.

Where physical guidance is reasonably necessary, it should be:

  • appropriate
  • instructional
  • limited to what is reasonably required
  • conducted in visible or observable training areas
  • consistent with professional boundaries and child-safety requirements

Where reasonably practicable, verbal instruction or demonstration will be used before physical guidance.

12. Premises Access, Check-In & Security

Access to KJ Arts Centre® may be controlled using reception procedures, barriers, screening, check-in processes, locked areas and other security measures.

Participants and visitors must follow access instructions.

Non-members, guests and visitors may be required to remain within designated areas unless authorised to enter training spaces.

Security cameras may operate in training and common areas for:

  • safety
  • security
  • access management
  • incident review
  • protection of participants and property

Cameras are not installed in bathrooms, change areas or other areas where privacy would reasonably be expected.

Security measures supplement but do not replace active supervision.

13. Attendance, Missed Classes & Make-Up Classes

Attendance, make-up classes, pauses, cancellations and session expiry depend on the specific membership, class package, promotion, event or program purchased.

Unless otherwise stated in the applicable package:

  • missed classes are not automatically refundable
  • missed sessions may expire
  • make-up classes are not guaranteed
  • make-up classes are subject to class capacity and availability
  • special promotional packages may exclude make-up classes
  • unused sessions may expire
  • illness, holidays or personal circumstances do not automatically create an entitlement to a refund or replacement session

Members should refer to the conditions attached to their selected membership, package or promotional offer.

14. Fees, Memberships & Payments

Program, membership, event and class fees must be paid in accordance with the payment arrangement selected during enrolment or purchase.

KJ Arts Centre® may use third-party payment providers for recurring or one-off payments.

Participation may be suspended or access declined where required payments remain outstanding.

Prices, inclusions, payment frequency, validity periods, promotional conditions, family discounts and other package-specific terms may vary depending on the membership or program selected.

These specific commercial terms will be displayed or communicated during enrolment, booking or purchase.

Nothing in these Terms & Conditions affects any non-excludable rights available under the Australian Consumer Law.

15. Marketing & Media Consent

KJ Arts Centre® may occasionally photograph or record classes, events, training sessions and activities.

Where media consent has been provided during registration, enrolment, Class Manager registration, event RSVP, promotional offer or another consent process, images or video may be used for:

  • social media
  • KJ Arts Centre® websites
  • digital advertising
  • printed advertising
  • promotional material
  • Centre displays
  • other reasonable KJ Arts Centre® marketing activities

Media consent can be withdrawn for future use by contacting KJ Arts Centre® in writing.

Withdrawal of consent does not necessarily require KJ Arts Centre® to remove material that was lawfully published before consent was withdrawn.

Where reasonably practicable, KJ Arts Centre® may avoid identifying individuals, blur faces, use group footage or take other reasonable measures where required.

Where participation is linked to a promotional offer that expressly requires media consent, withdrawal of that consent may result in the promotional arrangement ending or converting to the applicable standard pricing, where this was clearly disclosed as a condition of the offer.

16. Events, Workshops, Trials & Guests

These Terms & Conditions also apply, where relevant, to:

  • free trials
  • introductory sessions
  • school holiday programs
  • self-defence workshops
  • seminars
  • special events
  • Bring a Friend events
  • guest participants
  • promotional activities

A parent, guardian or authorised carer registering a child for an event confirms that they have authority to register that child and accept these Terms & Conditions on their behalf.

Guests may be required to complete separate registration, contact, emergency, medical or consent information before participating.

17. Suspension, Termination & Refusal of Participation

KJ Arts Centre® may reasonably suspend, terminate or refuse participation where necessary to:

  • protect participant safety
  • protect staff safety
  • protect the wellbeing or dignity of children
  • address unsafe behaviour
  • respond to serious or repeated misconduct
  • address breaches of Centre policies
  • address failure to follow reasonable safety instructions
  • manage health or medical risks
  • manage insurance risks
  • manage permit or operational requirements
  • address repeated access or supervision issues
  • respond to repeated late collection of children
  • protect the reasonable operation of the Centre

Any decision will be made reasonably and in good faith.

Any refund entitlement will be assessed according to the applicable membership, program or package terms and Australian Consumer Law.

18. Changes to Terms & Conditions

KJ Arts Centre® may amend or replace these Terms & Conditions where reasonably required to reflect changes in:

  • legislation
  • safety requirements
  • insurance requirements
  • Council or regulatory requirements
  • Centre operations
  • facilities
  • programs
  • services
  • technology or registration systems

The current version will be made available through the KJ Arts Centre® website or another reasonable communication method.

Continued participation after updated Terms & Conditions have been communicated may constitute acceptance of the updated Terms, subject to applicable law.

19. Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be severed to the extent necessary.

The remaining provisions will continue to apply.
